I would like to share the information that if you want to come here in Spain on a tourist visa, you can apply for student visa within 30 days upon arrival as an option to legalize your status. It is the government’s new imposed law or since 2019. The following are the requirements and in which you can get the approval in 2weeks or within a month from the day of its submission:
- health insurance certificate
- medical certificate
- translated NBI/police clearance
- bank statement/certificate with 10,000€ (as show money)
- visa letter from the university (requires enrollment fee)
- valid passport
In my case, it was already after 5 months upon my arrival here when we consulted a lawyer and have asked for advice how I can change or legalize my status. She said one of the options is to apply for a student visa and wait 7 to 8 months to get the result. I did take the risk despite the tedious months of waiting and voila, I’ve got the approval now even with the pandemia! It feels great to know that this method is possible and my stay in Spain has no more restrictions. I am sharing this information in the hope that it will be helpful for anyone who are seeking other option to legalize their status here in Spain unless you do the pareja de hecho or wait 3 years to apply for arraigo. What I did requires a lot of patience and perseverance especially in complying with the requirements. But with FAITH in God, whatever you ask, it will be answered at the right time. Apply within 30days upon your arrival here to avoid the 7 months waiting or consult a lawyer as they are updated with the government laws and will give you the best solution.
I highly recommend you contact the ‘Diaz and Asociados’ office and look for Atty. Antonia Diaz Marquez. Their office is at Calle Gran Via 57, 5’H, 28013 Madrid and you may refer at her contacts below for appointment. Her email address is maria.antonia@diazasociados.es.
Further, I would like to share some of my observations and helpful tips while trying to settle here in Spain. For those with irregular status here, try to not be consumed with fears when walking around the city or outside your house. As long as you are not committing any further violations here, the security personnel will not penalize you since the Spanish government has the arraigo program. They can be curious and suspicious at times but when asked, just be honest with your answer, present your passport, empadronamiento and they will give you even better advice. Best to always wear a smile esp when outside, it work wonders in any circumstances! Do not also fall easily to some facebook posts where it looks like this person has been given a liberty and authority to announce the official business of the security officers or government agencies. When in need of a reliable information, always look at the official government website.
With regards to the registration for empadronamiento, it is best to request your family member or friend living here in Spain to make a cita or appointment a month prior to your arrival here. This is not to lose days particularly when you need to apply for arraigo in 3years. On the part of the house or apartment owners who will help you register for empad’, they will not be penalized by accommodating irregulars or vice versa. One major purpose of the empadronamiento is to update the census or number of residents in a certain area or city.
In most cases, it is always recommended to read the government laws before one can impose their own regulations. It sometimes tends to make people have more fears to the unknown and delay the procedure.
In trying to acclimatize yourself in a new country, try to make an effort to meet new friends unless you are happy with being alone. I joined the Internations and it was helpful for me. You can also try joining the intercambio group because you will learn Spanish quickly. If you need to enroll Spanish course in a government school, search for CEPA as they have branches in different locations.
